I was a passenger in my own vehicle during a near fatal accident where the driver, who is an insured driver on my policy, had road rage with another driver. The driver ended up receiving a DUI as a result of the accident. I tried to sue my auto insurance company for under/unisured motorist, but since the accident was a sole vehicle accident, the insurance company would not settle for my injuries. Due to the nature of the accident and the result of the driver being intoxicated, the auto insurance company accepted liability for the driver's negligence and tried to settle for $4,200. I ended up hiring a lawyer because I have an unpaid hospital bill in excess of the settlement amount. In addition, I have had complications from my injuries and need lifetime treatments. We have an arbitration hearing next month, but the driver is only named on the lawsuit, not my auto insurance company. This accident happened in Pennsylvania and I had full tort, stackable, 100,000/300,000. My question is...why is the insurance company not insuring the named insured driver (who by the way happens to be my husband), on my insurance policy?

They took $2,265 off my ACV just for the difference. Is that fair? I don't get why they didn't just find a car with similar mileage to mine when there were plenty available. Why did they choose the two cars with the lowest mileage and then deduct 2 grand? When they could have easily picked two similar cars with at least 100k miles , and deducted a lot less for the difference.

This is more of a situational question than the main question suggests. So here goes: I live with my mom and am listed as an occasional driver on her car insurance policy. Alright, this is part two of my question. To recap, on March 25 I was in a two car motor vehicle accident in California. hi all i was hoping you could get some facts/and or legal advice. Ok so i have been renting this car for about 6 month now because i cant afford a down payment for my own. So I'm about to be 18 and have about $1,400 saved up towards a car, should be getting a few hundred more after graduation and from a few other things, so I expect to have around $2,000 in the summer. This is what I was planning on spending on a down payment on a cheap used car. For the monthly note and insurance, my parents said that they'll help at least some until I get a job. The thing is, it's seriously impossible to get a job in my town. I've been trying for a couple years and just nothing. Most other people I know - not just teenagers - are having the same problem. Because of this, my parents are worried that having to pay for so much and me pay for basically just the down payment would be too much on them. They're struggling very hard financially and haven't bought a car themselves in 13 years. So I was looking at some car websites the other day and noticed that some of them had really appealing lease deals. The ones that most caught my attention were $0 down, and then a monthly payment of around $200 or less per month for three years. What really interested me about that deal is the no down payment, because if there's no down payment and they pay for the monthly note, then that's the only thing they have to pay, at least for quite a while. That leaves me with around $2,000 still in pocket to spend over time on insurance, gas, various maintenance costs, etc., plus if there are too many hidden fees, etc. in the lease. (My dad got me an insurance quote and it was a lot lower than I expected btw, about $560/yr.) That seems so much better than having to start back at $0 after buying the car having paid all the rest on the down payment. I just don't wanna spend that much down because then I'm left with nothing, if I can't get a job then I have no way to pay for everything, again my parents don't think they can pay too much. If they only have to pay the monthly note, then I still have quite a while to get a job and start making money before that couple thousand runs out and if I do eventually get a job (hopefully it'll be easier in another city, but I need a car in order to move), I can even help them with the monthly payments or pay all of them. But all they can say is, Why lease a car when you can buy one, you'll just be stuck in the same spot in three years. But this is completely missing the point. The problem here is that if I spend everything down, then I have nothing left to maintain the car with, and therefore can't have a car at all. I have no steady source of income and can't make a steady source of income without a car. But if I can afford to maintain a car for at least several months with money I already had and can later get a job in a bigger city, I at least have some car, regardless of whether not I own it or it's the best and wisest financial decision in the long run. Once I have a car I can move to a bigger city and hopefully go to college and then get a better job, I'm sure I can get another car later. So basically, if I want a car now (which I need one in order to advance my life and go to college and such) the only possible way is if I lease instead of buy, unless I suddenly come into a bunch of money or can find a car for sale with no down payment. I need to just do whatever I have to do to have a car and get by at the moment, but my parents won't let me. My question is, if my car deductible is $500, and if the resulting cost of the repair is less than the deductible, do I have to pay the deductible? A few nights ago I accidentally brushed the side of my neighbor's car with my front bumper (cause she was parked like an idiot as usual). I'm taking full responsibility of it cause it's my fault and I have no problem with that. Initially I was going to pay for the scrape to be compounded out and whatever else was wrong as a result of me hitting it. However, when I spoke to her, she started pointing out a ridiculous amount of things: there's a scratch in addition to the scrape (ok, sure), she says I cracked her light (maybe I did, it's possible) but she's also saying that I caused her tire to pop out and that there's tread missing from it (which makes absolutely no sense because I didn't hit the tire or rim or wheel well at all). Basically, she expects a whole new paint job and a set of tires which is ridiculous for the small amount of damage that was done. I want to make sure she isn't trying to take advantage of my insurance company and cause my rates to skyrocket as a result. The car is a complete piece of sh*t and she doesn't take care of it at all - the paint's dull, the rims are rusted - and I think she's trying to fix these things by making it like they were a result of me hitting her. I have no problem at all taking responsibility for the damage I did, but I do have a problem with her making things up and trying to fix other issues through my insurance company. The last claims representative I spoke with told me that I would not be contacted by the adjuster at all since there is no damage to my car. Since she's going to be talking with the adjuster and I won't, I'm afraid she's going to exaggerate the amount of damage. Should I call my insurance company and tell them this? Will they care? What can I do?

I am 20 years old and make about $250/week (bi-weekly checks vary from about $420-520 after taxes). I am in desperate need of health insurance and I badly need dental coverage. This is horrible, but I need at least 5 fillings maybe more. I have weak enamel and I am prone to cavities. Minor car accident (not at fault) - should I go to my insurance or small claims court?

I was wondering if anyone could give me some advice. Last week I was involved in a minor car accident. I was at a stop light and the car behind me decided they could not wait and they tried to get by my car to make a left turn. They did not have enough room and scraped against my car with theirs. No one was hurt and no police were called. We pulled over and I got their name, phone number and address. They did not give me their insurance information and said they'd like to settle outside insurance because there are only scratches. I know it was stupid but I said okay. Also I do not have the license plate number of the car. I thought I wrote it down but I did not (I understand this is a big mistake on my behalf). We made contact over phone throughout the week and discussed repairs but suddenly they stopped answering my calls. I believe they are avoiding me. Now I am at a loss of what to do. Should I take this issue up with my insurance (at the risk of raising my premiums) or should I take this to small claims court? In either case I do not have the car's license plate so if it isn't their car will that be insufficient evidence to prove they are at fault (my word against theirs)? At the end of the summer I am allowed to buy my own car. At that time I will have been driving for about a year and a half under my parent's insurance. So I plan neither to report to DMV nor to file a claim. But one friend of mine suggested that in this case, I should still notify (but not to file a claim to) my insurance company. His argument is that the other party can still come back and sue me (if he is a freak). While we didn't exchange information, the other party may have remembered my license plate number so theoretically he could find out all other information about me. Hi i'm 18 and my driving test is coming up soon and i always look for quotes on cars to see for the future. My mum said she will possibly give me her car and get a new one if i pass. But on insurance quotes for the car i will be getting i will be the main driver but not the policy holder or registered keeper as i still live at home with her and she will still use the car to go shopping and things like that but I will drive that car the majority of the time. First off I am in CA and the other liable insurance is Farmers or 21st century. For some reason Farmers is handling the claim. Ok, so I was in an accident in which the other party was at fault. I had a claim against a guys insurance company for damage he caused. They came out today and did an evaluation and now the insurance estimator is saying that the vehicle needs to be totaled and that I will be offered some low ball figure because my car has prior damage which was only cosmetic and minor nothing structural at all. I know that the vehicle will be worth more than they are going to offer. But I just want a fair price for the car. Well, i passed my driving test yesterday yay! I got a car from a friend but i'm having trouble finding somewhere to insure me without having to pay like tons of money.
