Ok i live in Orange County in California. Yesterday on my way to school i got t-boned by a 1998 Ford F150. I drive a 1998 Honda Prelude. I was driving down a street and the light turned yellow so i ran it and the guy was waiting to make a left turn at a yielding section, he saw me coming when the light turned yellow and he just stepped on the gas and T-boned me on the driver side. I just found out my registration expired back in Oct of 2008. Minor car accident (not at fault) - should I go to my insurance or small claims court?

I was wondering if anyone could give me some advice. Last week I was involved in a minor car accident. I was at a stop light and the car behind me decided they could not wait and they tried to get by my car to make a left turn. They did not have enough room and scraped against my car with theirs. No one was hurt and no police were called. We pulled over and I got their name, phone number and address. They did not give me their insurance information and said they'd like to settle outside insurance because there are only scratches. I know it was stupid but I said okay. Also I do not have the license plate number of the car. I thought I wrote it down but I did not (I understand this is a big mistake on my behalf). We made contact over phone throughout the week and discussed repairs but suddenly they stopped answering my calls. I believe they are avoiding me. Now I am at a loss of what to do. Should I take this issue up with my insurance (at the risk of raising my premiums) or should I take this to small claims court? In either case I do not have the car's license plate so if it isn't their car will that be insufficient evidence to prove they are at fault (my word against theirs)? At the end of the summer I am allowed to buy my own car. At that time I will have been driving for about a year and a half under my parent's insurance. I have 2 options as far a buying a car: putting about a $5000 down payment on a car and my parents paying off the rest before I graduate college, or buying a car for $5000. Audatex is not kelly blue book they look at craigslist & not the dealer. Craigslist sometimes has cars where a mechanic might not catch it but is damaged. The price I paid is higher due to getting sick & credit went down so I had to go to a local dealer with higher interest. They want the insurance check plus $1700.00 & interest. So I will pay for this thing for over 1 1/2 years. I had it 6 days when some crazy driver almost hit me I turned & hit a wall. The insurance company says I loose my good driver discount. Since I will have to wait to pay off this car I can cancel my insurance once the dealer gets the check. Is there any California law that would say if this happens I would be able to pay off the car. It's worth more as a loss then to try to fix it. Please help. Thank You.

Hello. I recently got rear-ended and had an estimate done for $1800 dollars and somebody told me they would never give me that much for my car. I looked up the Kelley Blue Book and a private party price would be about $750 and that's how much they would give me and THEY take the car. Is this right? I might do it $750 and I keep the car! I put a new clutch in it, new front brake system, new exhaust, I love the car, so it's worth much more to me.....I'm just wondering what the law is on it and what I might be able to do to maximize my payout. If I'm unhappy with their offer can I take them to small claims and win? I just can't believe that I was just sitting at a stoplight and BOOM my car's wrecked and since I'm poor I can't get it fixed ya know? Thank you for your time......

I am a university 20 year old student and I will be insuring my first car next month. I was just wondering if I would be able to use my home address for the insurance details ro whether I would have to put my term time address. i ask this because I come from Wiltshire (low risk) and I go to uni in Birmingham (high risk). Insurance company won't pay till this person is certified dead which in state of IL wait for that is 7 years.
